Privacy policy of the KHM


In accordance with the provisions of the German Telemedia Act (TMG) and the North Rhine-Westphalia Data Protection Act, this privacy statement informs users of our website about the nature, scope and purpose of the collection and use of personal data by the Academy of Media Arts Cologne (KHM).
In general, personal data is any information that can be used to identify a person. In addition to direct information about the person, such as name, date of birth or telephone number and IP address, this also includes data about personal characteristics, beliefs or relationships that allow conclusions to be drawn about a specific person.
KHM only processes personal data if this data is necessary for the fulfillment of its tasks. The legal requirements in the Kunsthochschulgesetz NRW and the Landesdatenschutzgesetz NRW apply to this.
The protection of personal data is an important concern for all members of the KHM.

She works to ensure compliance with data protection at the Kunsthochschule. All public bodies that process personal data appoint official data protection officers in accordance with Section 32a (1) sentence DSG NRW. The colleges of art and music in NRW have appointed a joint data protection officer. She is involved in all data protection-relevant processes in university operations so that she can advise on the selection and design of data processing procedures and monitor compliance with legal requirements. This also includes training sessions for staff or faculty. The data protection officer maintains the directory of existing procedures for processing personal data (procedure directory) and checks whether new data processing procedures are permissible through prior checks.
In addition, she is the contact person for all inquiries from university employees and citizens regarding the handling of personal data at the university. Data protection officers are always bound to secrecy.

If you address letter mail to "the data protection officer" or "data protection", the mail will not be opened until it reaches the data protection officer.

On our websites we use personal data for the following purposes: Access data / server log files
Each time a user accesses a page and each time a file is retrieved from the KHM website, access data transmitted by the user's browser is stored.

Each data record consists of:
    - Browser type and version
    - Computer name or IP address of the accessing computer
    - Date and time of access
    - Requested file (web page, image, document)
    - Referring web page
    - Amount of data sent


These data are essential for the delivery of the website and thus the visibility of the content. The legal basis for this processing is Art. 6 para. 1 lit. e. DSGVO and § 3 para. 3 KunstHG.

This data is evaluated exclusively for statistical purposes and then deleted. If it is possible to enter personal data (e.g. e-mail address, name, address, etc.) on the website of the Academy of Media Arts Cologne, the data is collected on the basis of the user's voluntary consent, which can be revoked at any time.
The KHM uses Matomo, an open source software for statistical analysis of visitor access. This evaluation allows us to improve both the content and the use of the pages and to detect errors more quickly.


Contacting
When contacting KHM (for example, via contact form or e-mail), the user's details will be stored for as long as is necessary to process the request and any follow-up questions.


Newsletter
Through newsletters, we inform you about the activities of KHM at your own request and may therefore base data processing in this regard on your consent. You can revoke your consent at any time. When you register, we store the email address you provide, as well as your IP address and the date of registration. The latter serves to prevent misuse of your data. The data will not be passed on to third parties.


Transmission to third parties

As a matter of principle, we do not transmit data processed within the framework of our Internet presence to third parties. In individual cases, this may be done on the basis of legal permission, for example for the purpose of asserting claims for damages. If technical service providers are given access to personal data, this is done on the basis of a contract pursuant to Art. 28 DSGVO.

In principle, no personal data is transferred to countries outside the European Economic Area and associated countries (no "third country transfer"). If this should be necessary, we will inform you separately.


Notes on social media appearances

The social media pages of the KHM and individual institutions are also visible to everyone without registration. A personal profile is required for interactions. If you set up a personal profile, the providers will ask you to enter personal data (such as your name and date of birth). You can determine the extent to which you make your information available to the public in the respective privacy settings. Please refer to the data protection notices there and the KHM social media policy for information on the purpose and scope of data collection and the further processing and use of your data by the providers, as well as your rights in this regard. The university has no influence on this data processing by Facebook, Instagram, Linkedin or YouTube. KHM itself does not collect any data in its social media presences.

Spam
The use of published postal addresses, telephone or fax numbers and email addresses for marketing purposes is prohibited, offenders sending unwanted spam messages will be punished. We reserve the right to take legal action against the senders of so-called spam mails in the event of violations of this prohibition.
